These Terms and Conditions ("Terms") govern your access to and use ofviewsfromtheoperation.com and any related services, features, content, and functionality offered by Smiths Group, LLC under the brand Views From the Operation(collectively, the "Site").

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 13 years old to use the Site. By using the Site, you represent and warrant that:

  • You are at least 13 years old
  • You have the legal capacity to enter into these Terms
  • The information you provide is accurate and current
  • Your use of the Site does not violate any applicable law or regulation

2. Accounts

Certain features of the Site require you to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

However, by submitting User Content to the Site, you grant Smiths Group, LLC a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, adapt, modify, publish, display, distribute, perform, promote, market, and use your User Content in connection with operating, improving, advertising, promoting, and providing the Site and related business activities.

This license includes the right to use your User Content in promotional, editorial, social media, and marketing materials relating to the Site and our business, without further notice or compensation to you, to the extent permitted by law.

You represent and warrant that:

  • You own your User Content or have all rights, permissions, and authority necessary to submit it and grant the license above
  • Your User Content does not infringe, misappropriate, or violate any third-party rights, including copyright, trademark, privacy, publicity, or contractual rights
  • Your User Content is accurate where it purports to describe real events, places, or circumstances
  • Your User Content complies with these Terms and all applicable laws

4. Content Moderation and Approval

All submitted photos and captions are subject to review before they become publicly visible. We may, in our sole discretion, approve, reject, delay, remove, edit, restrict, or disable any User Content or account at any time, with or without notice, for any lawful reason.

We are under no obligation to publish any User Content and do not guarantee that submitted content will be made public.

5. Prohibited Content

You agree not to use the Site to:

  • Upload or post content you do not own or have permission to use
  • Upload or post copyrighted material belonging to someone else without authorization
  • Upload, post, or transmit unlawful, fraudulent, defamatory, harassing, threatening, hateful, obscene, sexually explicit, violent, or otherwise offensive content
  • Upload or post content that invades privacy, publicity, or proprietary rights
  • Impersonate any person or entity or misrepresent your affiliation
  • Submit spam, scams, malware, viruses, or harmful code

We may investigate reports but are not obligated to take any specific action in response to a report.

7. Copyright and DMCA Policy

8. Intellectual Property Rights in the Site

Except for User Content, the Site and all related content, features, functionality, branding, design, software, text, graphics, logos, compilations, and other materials are owned by or licensed to Smiths Group, LLC and are protected by intellectual property and other laws.

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, or exploit Site content except as expressly permitted by these Terms or by law.

9. Advertising and Third-Party Services

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY CONTENT WILL BE COMPLETE, ACCURATE, RELIABLE, OR SUITABLE FOR ANY PURPOSE.

12. Limitation of Liability

14. Termination

We may suspend or terminate your access to the Site, remove content, or delete your account at any time, with or without notice, for any lawful reason, including if we believe you have violated these Terms or created risk or exposure for the Site or others.

You may stop using the Site at any time and may request account deletion subject to our Privacy Policy and legal retention obligations.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Arizona, without regard to conflict of laws principles.

To the maximum extent permitted by law, any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Arizona, and you consent to the personal jurisdiction and venue of those courts.

16. Changes to the Site
